1. Acceptance of Terms

By accessing or using Engineering and Network Services ("ENS", "we", "us", or "our") hosting, cloud computing, backup storage, or network services, you ("Customer", "you", or "your") agree to be bound by these Terms of Service ("Terms").

If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these terms.

2. Service Description

2.1 Hosting Services

  • Shared hosting, VPS hosting, and dedicated server solutions
  • Web hosting with cPanel/WHM management interfaces
  • Email hosting and domain management services
  • SSL certificates and security services

2.2 Cloud Services

  • Scalable cloud computing instances and storage
  • Load balancing and auto-scaling solutions
  • Content Delivery Network (CDN) services
  • Cloud migration and consulting services

2.3 Backup and Storage

  • Automated backup solutions with multiple retention policies
  • Disaster recovery and business continuity services
  • Archive storage for long-term data retention
  • Cross-region data replication

2.4 Network Services

  • DDoS protection and security monitoring
  • VPN solutions and secure remote access
  • Network optimization and performance monitoring
  • Bandwidth management and traffic analysis

3. Service Level Agreement (SLA)

3.1 Uptime Guarantee

ENS guarantees 99.9% uptime for hosting and cloud services, measured monthly. Planned maintenance windows are excluded from uptime calculations.

3.2 Support Response Times

Critical Issues

3.3 SLA Credits

If we fail to meet our uptime guarantee, you may be eligible for service credits as follows:

  • 99.0% - 99.8% uptime: 10% monthly service credit
  • 95.0% - 98.9% uptime: 25% monthly service credit
  • Below 95.0% uptime: 50% monthly service credit

4. Payment Terms

4.1 Billing Cycle

Services are billed monthly in advance. Usage-based charges (bandwidth overages, additional storage) are billed in arrears.

4.2 Payment Methods

We currently accept PayPal payments. Additional payment methods including credit cards and bank transfers will be available soon.

4.3 Late Payments

Payments are due within 30 days of invoice date. Late payments may result in service suspension and additional fees. Services may be terminated after 60 days of non-payment.

4.4 Refund Policy

Monthly hosting plans: 30-day money-back guarantee for new customers. Setup fees and domain registrations are non-refundable. Usage-based charges are non-refundable.

5. Acceptable Use Policy

Prohibited Activities

You may not use our services for:

  • Illegal activities or content that violates applicable laws
  • Spam, phishing, or unsolicited bulk email
  • Malware distribution or hosting malicious content
  • Copyright infringement or intellectual property violations
  • Resource abuse that affects other customers
  • Cryptocurrency mining without prior approval

5.1 Resource Usage

Shared hosting accounts are subject to fair usage policies. Excessive resource consumption may require upgrade to VPS or dedicated hosting.

5.2 Content Responsibility

You are solely responsible for all content hosted on our services. We reserve the right to remove content that violates these terms or applicable laws.

6. Data Protection and Privacy

6.1 Data Security

We implement industry-standard security measures including encryption, firewalls, and access controls to protect your data.

6.2 Data Backup

While we provide backup services, you are responsible for maintaining your own backups. We recommend regular off-site backups for critical data.

6.3 Data Location

Data is stored in our partner datacenters across Chile, Colombia, Brazil, USA, and Canada. You may request specific data location requirements.

6.4 GDPR Compliance

For EU customers, we comply with GDPR requirements. See our Privacy Policy for detailed information on data processing.

7. Limitation of Liability

ENS's total liability for any claims arising from these terms or your use of our services shall not exceed the amount paid by you for the specific service during the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

8. Termination

8.1 Termination by Customer

You may terminate services at any time with 30 days written notice. No refunds will be provided for prepaid services except as specified in our refund policy.

8.2 Termination by ENS

We may terminate services immediately for violations of these terms, non-payment, or illegal activities. We will provide 30 days notice for termination without cause.

8.3 Data Retrieval

Upon termination, you have 30 days to retrieve your data. After this period, data may be permanently deleted.

9. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email 30 days in advance. Continued use of services after changes constitutes acceptance of new terms.
